In Tennessee people are eligible for a restricted license after a
First Offense DUI or Implied Consent in certain situations.

Any other cancellations, suspensions, or revocations must be reinstated before eligible
for a restricted driver license. Only 1 (one) restricted license can be issued within a 5
(five) year period.  The following table outlines procedures for obtaining a restricted
license
DUI 1st Offense
CHILD ENDANGERMENT-DUI
ALLOWING INTOXICATED PERSON TO DRIVE (T.C.A. 55-10-403).

  1. Obtain certified order from court where convicted, or court in county of residence, to drive to and from
    person's regular place of employment, or going to and from and attending a court-ordered alcohol DUI
    program, or to and from school if enrolled full time in a college or university, or to a scheduled
    interlock monitoring appointment.
  2. Obtain SR-22 from liability insurance company showing currently in effect.
  3. Pay $67.00 driver license fee for class "D" and $71.00 for CDL.
  4. Pass driver license examination.
  5. Must present original and one copy of order, SR-22, and driver license fee to Driver License Examiner
    within 10 days of order being certified.

NOTE: If CDL holder is convicted of DUI in a private vehicle, they can apply for a restricted driver license for
a CMV. But, if the CDL holder is convicted of a DUI in a CMV, they can only apply for a restricted Class D
license.
DUI 2nd Offense
(only available after 1st year of revocation period)

  1. Obtain certified order from court where convicted, or court in county of residence to drive to and from
    person's regular place of employment, or going to and from and attending a court-ordered alcohol DUI
    program, or to and from school if enrolled full time in college or university, or to a scheduled interlock
    monitoring appointment.
  2. Install ignition interlock device on vehicle to be operated since will be required to take full driver
    license test.
  3. Obtain SR-22 from liability insurance company showing currently in effect.
  4. Pay $67.00 driver license fee for Class "D" and $71.00 for CDL.
  5. Pass driver license examination.
  6. Must present original and one copy of order, SR-22, and driver license fee to Driver License Examiner
    within 10 days of order being certified.

IMPLIED CONSENT T.C.A. 55-10-406
DRAG RACING T.C.A. 55-10-503

  1. Obtain certified order from court where convicted, or court in county of residence, to drive to and from
    person's regular place of employment, or going to and from and attending a court-ordered alcohol DUI
    program, or to and from school if enrolled full time in a college or university, or to a scheduled
    interlock monitoring appointment.
  2. Obtain SR-22 from liability insurance company showing currently in effect.
  3. Pay $67.00 driver license fee for class "D" and $71.00 for CDL.
  4. Pass driver license examination.
  5. Must present original and one copy of order and driver license fee to Driver License Examiner within
    10 days of order being certified.
COURT ORDERED SUSPENSION
(History Code 55-T.C.A. 55-50-503)

  1. Obtain certified order from court where convicted to drive to and from person's regular place of
    employment, or going to and from and attending a court-ordered alcohol DUI program, or to and from
    school if enrolled full time in college or university, or to a scheduled interlock monitoring appointment.
  2. Pay $67.00 driver license fee for Class "D" and $71.00 for CDL.
  3. Pass driver license examination.
  4. Must present original and one copy of order and driver license fee to Driver License Examiner within
    10 days of order being certified.
FREQUENT TRAFFIC VIOLATION SUSPENSION (T.C.A. 55-50-505)

  1. Request a Driver Improvement Restricted Application Form by writing the Driver Improvement Office or
    calling (615) 251-5235, or obtain from the Hearing Officer on date of hearing. All information on form
    must be completed.
  2. Submit completed form to Driver Improvement Section, 1150 Foster Avenue, Nashville, TN 37210 for
    approval. Driver Improvement will return the application either approved or denied.
  3. Obtain SR-22 from liability insurance company.
  4. Present approved application form, SR-22 form, and driver license fee to Driver License Examiner and
    pass driver license examination.  
18-20 YEAR OLD ALCOHOL BEVERAGE VIOLATION - 1st OFFENSE
(T.C.A 57-4-203 & 55-10-705)

  1. Obtain certified order from court where convicted to drive to and from an education institution or to
    and from and working at regular place of employment.
  2. Pay a $20 driver license fee
  3. Pass driver license examination.
  4. Present order and $20 fee to Driver License Examiner.
18-20 YEAR OLD ALCOHOL BEVERAGE VIOLATION - 2nd OFFENSE
(T.C.A. 57-4-203 & 55-10-705)

  1. Suspension for 1st offense must be reinstated.
  2. Must serve one year of 2nd offense suspension period.
  3. Obtain certified order from court where convicted to drive to and from an education institution or to
    and from and working at regular place of employment.
  4. Pay a $20 driver license fee.
  5. Pass driver license examination.
  6. Present order and $20 fee to Driver License Examiner
DRUG FREE YOUTH ACT (DFYA) - 1ST OFFENSE
(T.C.A. 55-10-705)

  1. Obtain certified order from court where convicted to drive to and from an education institution or to
    and from and working at regular place of employment.
  2. Pay a $20 driver license fee
  3. Pass driver license examination.
  4. If under 18, submit completed compulsory school attendance form if first time to apply for a TN driver
    license.
  5. Present Order, $20 Fee, and school form if needed to Driver License Examiner.
DRUG FREE YOUTH ACT - 2ND OFFENSE
(T.C.A. 55-10-705 )

  1. Suspension for 1st offense must be reinstated.
  2. Must serve one year of 2nd offense suspension period
  3. Obtain certified order from court where convicted to drive to and from an education institution or to
    and from and working at regular place of employment.
  4. Pay a $20 driver license fee.
  5. Pass driver license examination.

    license.
  7. Present order, $20 fee, and school form if needed to Driver License Examiner.
FAILURE TO ESTABLISH FINANCIAL RESPONSIBILITY FOLLOWING AN ACCIDENT OR FINAL
JUDGMENT ON AN ACCIDENT
(VALID ONLY WHILE DRIVING COMPANY VEHICLES ON COMPANY BUSINESS)
(T.C.A. 55-12-132)

  1. Submit letter from employer requesting restricted license and that individual will be driving company
    vehicles on the job.
  2. Submit SR-22 form from the employer's insurance company filed in the name of employer and on
    behalf of the person (employee) applying for the restricted.
  3. Submit initial compliance needed such as release, affidavit of non-suit, bankruptcy, etc.
  4. Submit required restoration fee.

The above items must be submitted at a Reinstatement Office for approval of the restricted to be issued.

Approval letter presented along with $67 driver license fee for Class "D" or $71.00 for CDL to a Driver
License Examiner.
Must pass driver license examination.

DUPLICATE RESTRICTED DRIVER LICENSE

If changing resident address or place/hours or other restrictions of employment, must obtain a
new order from the court
listing the correct information or if restricted is for frequent traffic violations then
must complete new Driver Improvement Application and be approved.

  • Present new order or form at Driver License Station along with appropriate duplicate driver license fee
    ($8 or $12).

Frequent Reasons for Denial of Restricted Driver License Application

  • When an application is received by Financial Responsibility, the application and driving record are
    reviewed. The restricted driver license will be denied for the following reasons:

  • The DUI occurred on or after July 1, 2000 and there is a prior conviction of DUI, Child Endangerment
    by DUI, Allowing an Intoxicated Person to Drive, or Adult Driving While Impaired within 10 years, or
    Vehicular Homicide, Intoxication Proximate Cause, Aggravated Vehicular Homicide,or Vehicular
    Assault.

  • The order is issued for a suspension/revocation for which we do not have the authority to issue a
    restricted license.

  • The requested route is not for a location designated by law (alcohol program, school, work, or
    interlock appointment).

  • The order must have the violation, date of violation, conviction date, and disposition.

  • The order is not signed by the judge or if Driver Improvement Section approval not been granted.

  • A check of the driver records shows person has other revocation/ suspension/ cancellation. Person
    must reinstate everything on driver record except for the violation for which the restricted license is
    being requested. If person has a violation that cannot be reinstated, a restricted license cannot be
    issued.

  • If the person has a revocation/suspension in another state, a check is done to determine the problem
    in the other state. If person has a problem other than the violation for which the restricted is being
    issued, the person is denied the restricted until the problem in the other state is cleared.

  • The SR-22 is not for the State of Tennessee or the company is not licensed in Tennessee.
