The Tennessee Criminal Sentencing scheme

(1) divides felonies into five classifications according to the
seriousness of the offense;

(2) separates offenders into five classifications according to
the number of prior convictions;

(3) assigns a span or range of years for each class of crime
committed by each class of offenders; and

(4) employs enhancement and mitigating factors to assess
the definite sentence within each range.

In determining where in the range to set the sentence, the judge must consider:

(1) The evidence, if any, received at the trial and the sentencing hearing;
(2) The presentence report;
(3) The principles of sentencing and arguments as to sentencing alternatives;
(4) The nature and characteristics of the criminal conduct involved;
(5) Evidence and information offered by the parties on the enhancement and
mitigating factors (see below); and
(6) Any statement the defendant wishes to make in his own behalf about sentencing.
